Terms of use

What a purchase from Pawgress will be governed by — and, honestly, which parts of it have not been written yet.

Nothing on this page is a contractual term. The terms of use have not been drafted or adopted by this business. What is published below is the structure they will take, with each section naming the decision that has to be made and the rule that requires it. Where something is already settled — because it is built into the system, or because statute fixes it — it is marked as such and it is true today.

1. Who you are contracting with

Pawgress is an own-inventory retailer. The seller on every order is the entity below — there is no marketplace seller between you and us.

2. Eligibility and accounts

Who may hold an account and place an order — minimum age, capacity to contract, and what happens to an account that is misused or shared.

One thing is already fixed by how the system is built: an account is identified by a mobile number verified with a one-time password, not by an email address and a password. Sign-in is not open yet, so there are no accounts to hold today.

3. Orders and when a contract is formed

At what point an order becomes a binding contract — on payment, on our acceptance, or on dispatch — and the circumstances in which we may decline or cancel an order we have accepted (a pricing error, stock that turns out to be unavailable, a failed serviceability check).

4. Prices, taxes and payment

Prices are in Indian rupees. The MRP shown against a product is, by law, inclusive of all taxes, and we never charge above it. What is added at checkout — delivery, and the cash-on-delivery handling fee — is shown in the order summary before you pay, never afterwards.

The total is recomputed on our servers from live prices on every request. Nothing sent by a browser can change what an order costs, which is a security property rather than a promise.

We store no card number, CVV or expiry. Card credentials are held by the payment gateway under the Reserve Bank’s tokenisation rules and never reach our servers, our logs or our database.

Whether the selling price displayed on a listing is inclusive of GST, and how the tax component is shown on the invoice. The tax engine that decides this has not been built, so no statement is made here either way.

The payment methods that will be accepted, any fee attaching to one, the chargeback route, and the contact details of the payment service provider — all four are named by rule 7(2)(c).

5. Cancellation, returns and refunds

These are set out in full — including what has not been decided — on the delivery and returns page, and that page forms part of these terms once both are published.

This much is the law, not our policy

No term on this page can be used to refuse to take back goods that are defective, deficient or spurious, or that are not of the characteristics or features advertised. A term that tried to would simply be unenforceable.

6. Subscribe & Save

The subscriber discount is 5% off every delivery on a repeating order. That rate is a real setting the pricing engine reads, not a marketing figure.

The subscription terms: when each delivery is charged, how a price change is notified and applied to a running subscription, how skipping, pausing and cancelling work and by when they must be done, and what happens if a scheduled payment fails.

7. Reviews, questions and anything you post

The rules for customer reviews and questions: who may post one, what licence we take in what is posted, and the grounds on which something is moderated or removed.

One thing is not up for drafting, because rule 7(3) forbids it outright: we do not post reviews of our own products and we do not misrepresent ourselves as a customer. Whether a review came from a verified purchase is recorded against the review and shown on the product page, so a reader can tell the two apart.

8. Using this site

Acceptable use: scraping, automated ordering, resale, interference with the service, and what we may do about an account that does any of them.

9. What is not sold here

No live animals of any species, no breeding or rehoming, no prescription-only veterinary medicines, and no services — no grooming, boarding, day care, training, transport, insurance or veterinary consultation. This is a permanent constraint on what this business does, enforced in the catalogue itself.

Nothing sold here is a veterinary product or veterinary advice. Anything about an animal’s health is a matter for a registered veterinarian.

10. Liability and warranties

The warranty position, the limitation of liability, and any indemnity — drafted by a lawyer against the Consumer Protection Act 2019, which limits how far a seller can contract out of its obligations to a consumer in the first place.

This much is the law, not our policy

As an inventory e-commerce entity that vouches for the authenticity of what it sells, we carry the liability for that authenticity. That is not something a term can shift onto a supplier or onto the customer.

11. Your personal data

How personal data is handled, what consent covers and how to withdraw it are in the privacy notice, and the self-service routes are in the Privacy Centre.

12. Complaints and grievance redressal

Consumer care and the grievance officer are on the contact page, along with the statutory clock the officer works to.

13. Governing law and disputes

The governing law and the forum for a dispute — the courts of the state in which the entity is registered, which cannot be settled until the entity is incorporated and its registered office fixed.

14. Changes to these terms

How a change to these terms is notified, when it takes effect, and whether it applies to orders already placed. A versioned effective date belongs at the top of this page once the terms exist to be versioned.
